MIDDLE WEST PUBNICO, N.S. -- On Oct. 13, Mi’kmaw fisher Jason Marr brought his catch to a lobster pound in Middle West Pubnico and a mob of commercial fishers formed outside. "I got myself barricaded in the lobster pound here," Marr said. Rocks were hurled, a vehicle was set on fire, and the building was raided.... Commercial fishers were upset that the Mi'kmaq fishers were setting lobster traps outside of the commercial lobster fishing season. They called on DFO stop them and some took matters into their own hands. RCMP now say 21 people have been arrested. "Hopefully charges come through for that," said Mike Sack the Chief of Sipekne'katik First Nation which was operating a moderate livelihood fishery at the time. "I’d like to see a lot more. You know there was hundreds of people at the wharf and at the pound and there just needs to be a lot more people held accountable." After months of talks with DFO over its moderate livelihood plan Sipekne'katik is now walking away from the table. In a letter sent to the Minister of Fisheries and Oceans Chief sack wrote it's clear "DFO does not have the desire nor the ability to recognize and implement our Constitutional right." "The MOU had DFO wanted to issue the license, which we had a problem with," Sack said. "They wanted to issue 10 which was a problem and they wanted each license to have 50 tags which was also a problem with us." Sack says DFO wanted Sipekne'katik to fish during the commercial season, which includes winter, an option he says isn't possible because his fishers' boats are too small. A few days after the Oct. 13 raid in Middle West Pubnico, the lobster pound burned down. A man who police called a person of interest went to hospital with life threatening injuries. On Friday, the RCMP would not confirm whether that person is still in hospital, but have since released a video of two people seen on surveillance nearby shortly after the fire began. "As of this time we haven’t arrested anybody nor charged anybody in that arson event," said Nova Scotia RCMP spokesman Sgt. Andrew Joyce.

Out of season lobster weren’t the only noticeable events in Pubnico today by First Nations, many were under the legal size limit. This is literally an attack on sustainability and the economy itself. Global investments in the lobster industry could be damaged heavily if our districts closed. This lack of respect for precious seeding periods could put a halt on global food supply, businesses such as retail, wholesalers, and the already suffering international restaurant industry could face issues with lacking supply. This isn’t just about fishermen, this industry employees and feeds many throughout the world. Nova Scotia RCMP remain on scene at a lobster pound in Digby County and are investigating threats and mischief following disturbances last evening. At approxima...tely 4 p.m. on October 13, Meteghan RCMP were called to a disturbance outside a lobster pound in New Edinburgh. Upon arrival, responding officers observed a group of approximately 200 people who were preventing employees from leaving the lobster pound and that some individuals were throwing rocks at the building and vehicles nearby. Officers on scene were able to keep the peace and attempted to mediate. While on scene, police extinguished a vehicle fire that was heavily damaged. In addition to the vehicle, there was damage to other personal and commercial property. The RCMP is investigating mischief and threats related to the disturbance. At approximately 9 p.m. on October 13, Yarmouth RCMP were called to a disturbance outside a lobster pound in Middle West Pubnico. While en-route, police were advised that the group was preventing employees from leaving and had caused damaged to the building. Upon arrival, officers observed approximately 200 people in the area and worked to de-escalate the situation and disperse the group. Unfortunately events escalated with further damages incurred. The RCMP is investigating reports of crimes against person and property including threats and mischief related to this disturbance. The investigations are ongoing. The Fisheries Department has been ordered to reconsider the case of a disabled Nova Scotia fisherman who is challenging a federal rule that prevents him from hiring someone to catch lobster under his licence. Dana Robinson of Parkers Cove has a medical condition affecting his leg that hinders his ability to stand on a boat for long periods of time. His boat was operating in the Bay of Fundy under a DFO provision that allows fishermen to designate a substitute operator once ...they provide adequate medical proof of their condition. The provision, however, only allows the substitution for five years. The time limit doesn't sit well with Robinson. Disabilities, he said, "last a lifetime." "So I don't know how you set five years on that," he said. "There's no more licences being made. And that's where I came from. This is what we did all our life. We're fishermen and that's what we do." Extension request denied DFO's deputy minister turned down Robinson's request for an extension in March 2019. Robinson, 60, filed for a judicial review of the decision in Federal Court on the grounds that the decision was discriminatory and his charter rights were being violated. In a Sept. 30 judgment, Justice Richard Southcott set aside the deputy minister's decision and ordered the application be reconsidered to ensure Robinson's charter rights are affected "as little as possible". Robinson's lawyer, Richard Norman, welcomed the decision. "It's about discrimination. It's about discriminating against fishermen who have a disability and who otherwise are in total control of their business and deciding on every day-to-day issue relating to their fishing enterprise," he said. Norman said rather than celebrating the ability of fishermen with disabilities to overcome challenges, DFO is telling them to "get out of the industry" because they can't physically be on the vessel. DFO 'considering its options' In a statement Monday, DFO said it is "considering its options regarding the Federal Court ruling on the case of Dana Robinson" and would not be making any further comments. Norman said the key question is what the new decision will be and how the deputy minister will accommodate Robinson's rights. "And you can be sure Mr. Robinson is going to be scrutinising whatever decision is made because it has an impact not just on him and his business and his livelihood, but for other individuals in his circumstance," said Norman. Robinson is not alone in his plight. Norman said he filed another challenge a few weeks ago for an individual in a similar situation. Robinson said he believes the five-year limitation should never have been a consideration in the first place. "This is a right that every Canadian should have, and it shouldn't even be part of DFO's decision," he said. "This isn't a DFO matter at all. It's nothing to do with conservation or anything."

Yesterday, I met again with local fishing industry representatives to address various concerns that have been raised. I very much appreciate our conversations ... your voices are important and I will continue to work with you. As confirmed in that meeting, there is no plan to move to a quota system for the commercial lobster fishery and it is not being considered. Discussions with First Nations continue at the same time, on a nation-to-nation basis, regarding how to further implement the affirmed Treaty Right to fish for a Moderate Livelihood. I greatly appreciate our frank and open conversations as well. Work is advancing on multiple fronts to find a lasting solution. Although there may be different perspectives, conservation remains a shared priority for everyone involved and it underpins everything we do. I appreciate the efforts by many to bring down tensions over the last number of weeks, creating the necessary space for reflection and allowing discussions on a path forward to happen. We must continue this work, keeping the lines of communication open, and continuing to approach the situation from a position of calm and understanding. The goal is, and has always been, to develop a strong, stable, and productive fishery for the benefit of everyone involved.

If I make C&C for the AFN this 2020.... We personally, along with hundreds of our fishermen have dealt racism, death threats, harassment, etc from native fishers when voicing opinions about the law being upheld for out of season fishing.
