FEAR OF FALLING As we are all getting used to protecting ourselves from the COVID-19 virus, we cannot forget the danger of falling. As we spend more time at home, we are at risk of falling: down stairs, down ladders, or tripping over objects. In 2016-17, 654,000 of the 2 million injury related visits to emergency departments were due to falls. That is approximately 1800 emergency visits per day across Canada. Aside from representing thousands of victims of falls over th...e years, I learned the hard way what it means. Last November, I was walking in a dark room with loose slippers and tripped on the edge of a carpet, dislocating my right shoulder and tearing off three tendons from the rotator cuff. A visit to the emergency department to relocate the shoulder was followed by arthroscopic surgery in February to reattach the tendons, and is now being followed by 6 months of physiotherapy. I do not want to burden our emergency departments again, especially when they are going to be overburdened by COVID-19 victims. So I am being extra careful, and would urge you to learn from my mistake and help out our front line workers by avoiding injury. See more

Jury duty is coming up next month in Oshawa. Almost all civil jury cases are personal injury cases. They will not tell the jury that any award they give to the plaintiff will be paid for not by the defendant but by the defendant's insurance. If it is a motor vehicle accident they will not tell the jury that any award for pain and suffering less than $127000 will be automatically reduced by $37000 at the end. This means that if the jury thinks the pain is worth 60000 that the plaintiff will only get 23000. The odds are stacked in favor of the insurers and against innocent accident victims.
