In Family Court, a final law decision is made at trial after several mandatory conferences and steps in accordance with the Family Law Act. Family Law Arbitration can streamline the process so that a binding final decision can be made in a more summary manner. When both spouses agree on the process, they can choose a Family Law Arbitrator to hear their evidence and make a binding decision on the issues they cannot agree on.... This process is performed in a private and confidential setting rather than in the open & public court system. The Family Law Arbitrator’s authority is derived from legislation that requires the parties to sign an Arbitration Agreement which outlines the issues that can be decided upon. The involved parties have the option to try mediation first, then move to arbitration if there is little or no progress or agreement possible. Alternatively, the parties can bypass mediation and go straight to arbitration. The Family Law Arbitrator is usually a senior Family Law lawyer with many years of specialized experience. Can an unmarried person in a romantic relationship still be liable for support payments? According to Latner v. Climans, the Ontario court has said "yes." The myth that no legal obligations to pay support arise from a romantic relationship where both parties keep their own residences and reside together intermittently has been dispelled. ... The court found that the couple had cohabitated together off and on for 14 years, even though they owned separate homes. With this, the court ruled that they were in a committed spousal relationship, and spousal support of $53,077 per month was ordered to be paid by Latner. The appeal court did not interfere with the findings of the case but limited the duration of his support payments to 10 years instead of indefinitely.
