Last week the Supreme Court released its decision in the landmark immigration detention case of Canada (Public Safety and Emergency Preparedness) v. Chhina. Simon Borys, of Borys Law, intervened in the case on behalf of the Canadian Prison Law Association. The Supreme Court implicitly adopted the CPLA's submissions, recognizing that a lawful detention gone bad can be the basis of a habeas corpus application. This case has wide ranging implications beyond just for immigration detainees.
