What Are the Benefits of Applying for a Trademark Registration 1.Registering your mark allows you to stop anyone who attempts to use or register a similar mark. A registered Canadian trademark holder has priority nationwide when there are any conflicts between businesses with the same or similar names. Five years after registration a trademark automatically becomes incontestable, eliminating nearly any trademark infringement defense. 2.When you apply for a Federal trademark r...egistration, all companies in Canada are considered on notice of your rights in your trademark; they cannot claim ignorance once the registration issues. In addition, obtaining a Federal registration allows you to use the trademark symbol for your name and logo. 3.Trademarks are "intangible" assets that build the value of your company. If you decide to sell your business or to take it public, registered trademarks will add to your company's value. 4.If someone tries to register a domain name that infringes on your trademark, you may be able to shut down the website based on your trademark registration. This benefit makes trademarks important for internet businesses where confusing names could direct traffic away from your web site. Additionally, if your mark is a composite or design mark it is beneficial to complement a trademark application with a copyright registration. Registering the copyright protected work (ie. logo) allows the facts related to the copyright to be on the public record and gives the registrant a certificate of copyright registration which acts as prima facie proof of ownership in the work

What is a trademark? A trademark is any word, phrase, logo, symbol, design, alphanumeric grouping, or combination thereof, adopted and displayed on wares or associated with services, and used for the purpose of identifying the products or services, and to distinguish them from the wares or services of others. The primary purpose of a trademark is as a source indicator, to prevent consumers from becoming confused about the source or origin of the product or service. A trademar...k generally indicates that the wares or services come from the same source as all other wares or services associated with the same mark. A trademark serves to symbolize the quality or characteristics of a product or service. Should you register your trademark? Although it is not necessary to register a trademark since as soon as a trademark is properly used common law rights arise, such rights are generally weak rights compared to the rights for a registered trademark. The common law rights that arise upon mere use of the trademark are restricted to the geographical region in which the trademark is used, or where the owner can establish a reputation in that trademark. What are the advantages of registration? Although it is not necessary to register a trademark in order to use it there are, nevertheless, some important advantages if one does register, including: i) a registered trademark can be enforced throughout Canada, whereas an unregistered trademark can be enforced only in those areas where it has been used to establish a beneficial reputation (referred to as goodwill) ii) the owner of a registered trademark may initiate infringement proceedings in either the provincial or federal courts, whereas the owner of an unregistered trademark may not initiate trademark infringement proceedings, but must rely on passing off proceedings iii) after a trademark has been registered for five years it generally cannot be challenged on the basis that another party used it, whereas there is no such similar cutoff for an unregistered trademark iv) a Canadian trademark registration can be used to claim priority in registering the trademark in foreign countries, whereas trademarks protected merely by common law rights have no such advantage.
