As an employment lawyer, I have seen that all too often the most vulnerable parts of our society - young people, students, immigrants, etc. - are the ones who feel the brunt of this injustice. And the worst part is that justice is almost completely unattainable for those who are not paid - usually due to the bureaucracy of the Ministry of Labour or the inhibiting legal costs of taking action. The penalties need to be increased-now. While most employers do not engage in this type of practice, those that do should face significant penalties. No matter how you slice it, employees deserve to be paid for their work. Whats fair is fair!

Reasonable Accommodation Employers have a duty to accommodate their employees to a point of "undue hardship". What does that mean? It is hard to tell. The concept of "undue hardship" has not been defined by the court or any tribunal in Canada. What we do know is that it means some hardship, or challenge is acceptable for an employer when they consider accommodating their employees. How does that affect you as an employee or a business owner? Simple. An employee who needs tim...e to pray (religious accommodation), has to leave early to pick up their children (familial accommodation) or cannot sit for long periods (disability accommodation) must be accommodated by their employer. If that accommodation is refused, that is discrimination - plain and simple. If an employee complains about being refused accommodation and is subsequently punished, that is worse - way worse. So what? Employers are liable for damages in those circumstances - and claims at the human rights tribunal can be costly. The best thing to do is for employers and employees to keep the lines of communication open so that everyone stays on the job rather than a courtroom.
