Important news for fathers making payments to the FMEP: The Family Maintenance Enforcement Program (FMEP) has ceased its enforcement programs. It will not seize drivers' licenses. ... It will not attach any new government paid relief. If you are a payor who has been laid off work, advise the FMEP immediately. In Vancouver call (604) 678-5670 Victoria (250) 220-4040 BC incl. Dear clients, The evolving situation with Covid-19 has restricted the BC court system to only the most essential matters. This means all family matters have been suspended. ... For the foreseeable future please contact me by e-mail ([email protected]) If you wish to talk by phone, please e-mail me your phone number and I will return your call. I intend, as best possible, to keep my practice open and running, although my physical office will be closed. If there is an absolute need to attend for the delivery of documents or to swear an affidavit we can figure out a way to do that in safety. Try to make the best of a situation beyond our control, so try to enjoy your quarantine to the extent that it is possible.

The Supreme Court and the Provincial Family Court are hearing only urgent applications. An initial email request is sent to the court registry setting out the facts and reasons for the urgency of the proposed application. The registry responds advising if a judge has declared the requested application urgent or not. To date applications to enforce an existing parenting plan that is being breached by the mother on the excuse of the quarantine are being designated as urgent.

COVID-19 is causing layoffs of fathers paying court ordered child support. I am suggesting that a mechanism be instituted to eliminate the difficulty of varying court orders based on documentary proof of the layoff. Here's the letter I sent to the FMEP today. cc David Eby... ========================== March 16, 2020 Re: COVID 19 and support payors being laid off Sir, I represent fathers registered with the FMEP paying court ordered support to former wives and mothers of their children. Administrators of the local Family and Supreme Courts are advising which matters are being adjourned and which matters can be heard if absolutely essential. COVID 19 has payors being laid off. Please advise what policies your department is prepared to put in place to accommodate them in the face of both the arbitrary cessations of income and the restricted access to courts to vary existing support orders. I am not suggesting a blanket Provincial relief from support obligation. I am suggesting a mechanism to obviate court applications to vary whereby documentary proof of being laid off in an individual case permits the case officer to waive enforcement proceedings until one of two events occur: 1) Employment insurance is received and a re-calculation of obligation under the guidelines is determined; 2) The payor is back in their former or some other employment.
