The question below is one we are often being asked by clients these days. The answer lies in following this basic rule: The law is designed to put the victim in the position in which he or she would have been had the accident/injury not occurred. Therefore, the impact of COVID-19 varies from case to case. Here are some examples: 1. John works in a business that was completely shut down (or maybe still is) because of COVID-19. He likely has no claim for loss of wages for the ...period of shutdown. 2. Catherine’s employer reduced staff but continued to operate even during the COVID-19 period. She would still have a loss of income claim if she could show that she would have been one of the people kept on by the employer. 3. Kevin has been off work more than a year because of injury and does not qualify for EI or CERB because of his extended time off. The most common cause of motorcycle accidents is unsafe lane changes and left turning cars or trucks who don’t see the oncoming motorcycle.
