In order to get a divorce you must file a petition for divorce. 3. Common-law couples who live together for 3 years have the same rights to property as people who are married - Regardless of how long you have lived together no party has an automatic right to property upon separation. 4. If you do not want to see your child, you do not have to pay child support - In New Brunswick, if you make over $12,000 annually and are not the primary caregiver of the child you have an obligation to pay child support. 5. If you deliberately stay unemployed or underemployed, or get paid cash you do not have to pay child support - The Courts in New Brunswick are able to impute income on parties who try to hide money and not work to avoid paying child support. Essentially, they will decide how much the payor should make a year and the payor would have to pay child support based on that amount.
