This is no doubt the most common question that we are asked on an almost weekly basis. The truth is that if your serious injuries are recent, we will not know. There is an old saying He who lives by the crystal ball will soon eat shattered glass. Most times, cases need to percolate. Injuries need to plateau. You must recover to some sort of medical baseline which is confirmed by experts. Orthopaedic and psych experts need to be retained to provide us opinions on your cond...itions. Wages need to be valuated, and present valued. Housekeeping losses need to be calculated, as does your future health care requirements and costs outside of no-fault benefits and OHIP. Collateral benefits need to be addressed i.e. what is deductible from what? Litigation risk needs to be thought out, as does liability. The dichotomy between your present injuries and losses and what your case is worth in the future, after recovery and better prediction, is very difficult to address and answer properly. Did you know that distracted driving (especially texting and driving) has caused more deaths in Canada than impaired driving in the last 36 months? Over 25% of reported car accidents involve a phone, including hands-free phones, but they’re still under-reported. Drivers using phones fail to process 50% of their road environments. Distracted driving causes 4,000,000 car accidents per year in North America. Distraction accounts for 60% of moderate and sever teen crashes. Distracted drivers are a danger to motorcyclists and other vulnerable road users. Motorcyclists account for a much higher proportion of traffic fatalities relative to the share of motorcycles among all motor vehicles and vehicle miles driven in Canada. They are also less visible to other drivers and pedestrians and less stable than four-wheel vehicles. Congratulations to Amber Lee from Kelowna BC on winning the Lalande Personal Injury Lawyers fall scholarship award! Amber’s story of perseverance through addiction is greatly inspiring. For over 13 years, Amber suffered from alcohol use disorder which debilitated her life. She started to drink at only 14 years old and saying goodbye to alcohol on June 8th, 2018 has been one of her most challenging, and rewarding, endeavors yet. Amber explained that after many alcohol fuel...ed highs and lows she realized that she was actually using alcohol daily to cope with her crippling social anxiety, anxiety and stress. Amber mentions: In our society, you are an anomaly if you don’t drink alcohol. You are asked Why did you quit drinking? But no one ever asks, Why do you drink alcohol? This mentality can make it extremely difficult to make that decision to stop, and to follow through, while still being social. So much is centered around the consumption of alcohol and it seems like every life occurrence needs to either be celebrated or mourned with it. I used to choose my activities based on whether I could sneak alcohol in with me or not. I hung out with friends that I knew would always be up for a drink. And I certainly didn’t date any men who didn’t make a habit of at least binge drinking on the weekends. But these days, I am excited about the thought of not drinking. I am totally okay with the thought of never drinking again. I barely ever think about having a drink. And I never would have thought that would be possible a couple of years ago. Struggle is the precondition for personal growth. I'm thankful for a past that has afforded me plenty of strength and empathy. Now, I am grateful for a clearer mind, a healthier body and more genuine connections in my life. Today, Amber has developed better and healthier connections and relationships. She is surrounded by positive influences and focusing on personal development. Amber will be going to school to be a helicopter pilot and we are happy to give her a small helping hand.
