There is a bit more paperwork to complete before they can return to Ottawa sometime early in the New Year. We can't wait to welcome them.

Last week, the Supreme Court of Canada (SCC) released its decision David Matthews v. Ocean Nutrition Canada Limited, 2020 SCC 26. This wrongful dismissal case clarified if and when additional compensation, such as bonuses or long-term incentive plan payouts, are owed to employees who are constructively dismissed or terminated without cause from their employment. In this video, Katie Brack explains the Court's decision and what it means for employers and employees. For full details and analysis, please visit - https://bit.ly/355R3N6.

Late on September 3, 2020, the Ontario government announced further amendments to extend the maximum periods of temporary layoffs to January 2, 2021, before they could be deemed to be terminations under the Employment Standards Act, 2000. Today was the date on which employers had to reinstate these employees to full capacity, failing which they would be deemed to be dismissed in the case of employees on a temporary lay-off or constructively dismissed in the case of employees who are working reduced hours (assuming the employees would not agree to continue to be laid-off or to work reduced hours).
