Some happy to news to share to end the year. After a wait of many years, and a wait made even longer thanks to COVID-19, Michael Abrams and his wife Natalie are in South Africa where they have completed the adoption of their son, Wyatt Esihle. There is a bit more paperwork to complete before they can return to Ottawa sometime early in the New Year. We can't wait to welcome them.

The Ontario government is moving forward with legislation to amend the Business Corporations Act (Ontario). The proposed changes will: - Remove the requirement that a minimum of 25% of the directors of an Ontario corporation be Canadian residents; and - Reduce the threshold for a written resolution from a unanimous signature requirement to a majority signature requirement, for privately-held corporations.... Last week, the Supreme Court of Canada (SCC) released its decision David Matthews v. Ocean Nutrition Canada Limited, 2020 SCC 26. This wrongful dismissal case clarified if and when additional compensation, such as bonuses or long-term incentive plan payouts, are owed to employees who are constructively dismissed or terminated without cause from their employment. Late on September 3, 2020, the Ontario government announced further amendments to extend the maximum periods of temporary layoffs to January 2, 2021, before they could be deemed to be terminations under the Employment Standards Act, 2000. Today was the date on which employers had to reinstate these employees to full capacity, failing which they would be deemed to be dismissed in the case of employees on a temporary lay-off or constructively dismissed in the case of employees who are working reduced hours (assuming the employees would not agree to continue to be laid-off or to work reduced hours).
This is good news for all potential homebuyers and especially those trying to enter the market for the first time. And remember, if you are thinking about purchasing a property please do not hesitate to call us for information about the process. - Mike D'Aloisio
