#LearnWithLouis: Settlement A settlement, in law, is a compromise or agreement between litigants to settle the matters in dispute between them in order to dispose of and conclude the case. Generally, as a result of the settlement, the case is withdrawn or dismissed without any judgment being entered. Settlement is a great opportunity for my clients to resolve their cases before going to trial and usually helps keep costs down for the parties.

Another amazing charity to support is Ronald McDonald House Charities Southwestern Ontario is a place where out-of-town families with seriously ill children can stay for as long as they need only 165 steps from Children's Hospital, London Health Sciences Centre. By providing things like a private room and bath, homemade dinners, laundry facilities, and all the other comforts of home for just $12 a night, we are able to help bring a bit of "normal" to families with sick kids... while lifting some of the financial burdens weighing on parents. With major renovations in 2011 bringing our House from 17 to 34 bedrooms, we continue to grow in order to provide comforting and supportive programs and services to help families going through very difficult times. #LearnWithLouisLaw: Cap on Damages for Pain and Suffering. Unlike in the United States, where in certain states, damages for pain and suffering awards can be quite large, the Supreme Court of Canada (SCC) capped the amount one can receive for pain and suffering damages. In 1978, the SCC decided on damages caps in three cases where plaintiffs were catastrophically injured. In these cases, the Court acknowledged that damages for pain and suffering must be determined based on individual circumstances of each case, but established an upper limit in order to bring consistency and stability to these damages awards. The SCC set the damages cap for pain and suffering at $100,000, which has been adjusted for inflation. The current upper limit on damages for pain and suffering is approximately $400,000.

#LearnWithLouisLaw: What is an Acquired Brain Injury? An Acquired Brain Injury is damage to the brain that occurs after birth from a traumatic or non-traumatic event. Traumatic ABIs occur from damage to the brain caused by a traumatic event such as a blow to the head, a fall, a sports related injury or a motor vehicle accident. These traumatic events happen unexpectedly and can affect anybody, including young and otherwise healthy people. ABIs can range from mild to severe; some people are able to quickly return to their regular activities while others can have permanent effects.

#LearnWithLouisLaw: Ontario’s no-fault Statutory Accident Benefits provides individuals who are injured in motor vehicle accidents medical and other benefits to assist them while recovering from their injuries. Every automobile insurance plan in Ontario includes the Statutory Accident Benefits, however, there are limits on the amounts of these benefits that can make it insufficient for those who are seriously injured. Under the Insurance Act, Ontarian's are able to purchase Optional Benefits that augment the Statutory Accident Benefits. #LearnWithLouisLaw: Mediation! A mediation is a voluntary meeting between the parties in hopes of settling the matter. A mediator, who is not a judge, is hired to be present. The mediator’s job is solely to facilitate settlement. A mediation usually begins with all parties in the same room. Opening remarks will be made by both sides, usually by the lawyers, but you are welcome to say something if you so desire. After this, the parties will break out into separate rooms - u...s in one room, and the opposing party and their counsel in the other room. The mediator will go between rooms, exchanging offers between the parties and trying to aid in settlement. The hope is that, prior to the end of the day, a number is agreed upon. If no settlement is agreed to, the offers exchanged cannot be relied on by either party later. The litigation process continues on as if the mediation never occurred. #LearnWithLouisLaw: The COVID-19 pandemic has changed the way things are done across many industries and the legal profession has had to adapt as well.On March 15, 2020, the Ontario Superior Court of Justice suspended all but urgent matters. If your matter does not settle throughout the normal course or at a mediation, and a trial is scheduled, a pre-trial conference is required. A pre-trial conference is a meeting between all parties in the litigation and a judge. The judge’s job is to give his or her opinion on the matter and try to facilitate settlement. It... is a confidential meeting that takes place at the courthouse, typically in the judge’s chambers. For the most part, the pre-trial conference is a chance for the lawyers to discuss the case with the judge. You may not be in the room for the entire conference. However, the judge may want to ask you some questions about the accident and how your life has been impacted. The judge may also talk to you about the strengths and weaknesses of your case.
