This is great news. Many of our clients are successful in their Humanitarian and Compassionate applications, based on the best interest of their children only then to be asked to submit lengthy, complicated submissions to prove that their disabled child would not cause excessive demand on our systems. We have been very successful in these submissions but the process is very contradictory to the values that are examined in an H and C application. Children qualify as dependants if they meet both of these requirements: they’re under 22 years old, and they don’t have a spouse or common-law partner. Children 22 years old or older (also known as an overage dependent children) qualify as dependants if they meet both of these requirements: they have depended on their parents for financial support since before the age of 22, and they are unable to financially support themselves because of a mental or physical condition."

This is a great decision, regarding a very grey area of immigration inadmissibility and appeal rights. Many of our prior clients have been adversely affected by this "undecided, unknown, in-between" that was created when appeal rights were changed.
