Desautel, 2021 SCC 17. The SCC took a purposeful step away from colonial constraints on the definition of Aboriginal peoples under Section 35, within the context of the Canadian state. The Court held that... the expression Aboriginal peoples of Canada contained in Section 35 refers not only to Indigenous peoples who are Canadian citizens, but more specifically to the modern-day successors of Aboriginal societies that occupied Canadian territory at the time of European contact, including Indigenous persons and groups that now reside outside of Canada. The case is an important development in Aboriginal law and in the ongoing journey towards rights-recognition and reconciliation with Indigenous peoples. The current CERB program has been extended by an additional four weeks, up to a maximum of 28 weeks of benefits. Currently under the Utilities Commission Act, small-scale electrical, gas, and other utilities owned or operated by First Nations are regulated as public uti...lities and subject to the same rate criteria as large utilities such as BC Hydro. This regulatory environment creates significant administrative and economic barriers for Indigenous Nations who wish to operate a utility, including IPP projects.
