18 to 22 months = average time from date of filing to examination of a trademark application in Canada. Just when I thought I couldn't be more frustrated with the examination delays for trademark applications, I got a call from an Examiner yesterday morning to discuss potentially changing the Classification of a mark that has been languishing in examination hell for over 4 years! A new Practice Notice allows CIPO (Canadian Intellectual Property Office) Examiners to talk directly to agents to make minor changes rather than issuing an Office Action for the minor formality issues. It's a welcome help, but clearly not a practice adopted by all CIPO examiners yet. Deep breaths...
