Evictions for Non-Payment of Rent can proceed with conditions On March 27, 2020 the Minister of Service Alberta issued several Ministerial Orders related to Residential Tenancies. No forced evictions were allowed during the month of April 2020.... Landlords were required to work with tenants who were unable to pay all, or a portion, of their rent as a direct result of COVID-19 and enter into a payment plan. All tenants were required to pay their rent in full. If they were unable to pay their rent in full or in part they had to enter into a payment plan with their landlord. Those tenants who: refused to pay their rent, or who refused to enter into a payment plan, or who entered into a payment plan and failed to abide by the terms of the plan could face eviction beginning on May 1st. As of May 1st, landlords seeking to evict a tenant for the non-payment of rent may only do so if you can satisfy the court that the conditions set out in #4 above apply. You want to ensure that you have documentation to support this. If you do not, then you may not be successful in your application to terminate the tenancy. Late Payment Fees or Penalties Prohibited between April 1 and June 30, 2020 See Ministerial Order SA:003/2020 https://open.alberta.ca//sa-mo-2020-003-late-payment-fees- The landlord shall not charge a fee or penalty for late payments of rent or non-payment of rent by tenants between April 1 and June 30, 2020. This includes: the imposition or charging of late fees or penalties period between April 1 and June 30, 2020, and the enforcement or collection of late fees or penalties charged on or after July 1, 2020 for the period between April 1 and June 30, 2020 . Rent Increases See Ministerial Order SA:006.2020 https://open.alberta.ca//sa-mo-2020-006-rental-increases.p If a fixed term tenancy expires or has been terminated, but the same parties have entered into or are entering into a new residential tenancy residential tenancy agreement to the same residential premises and such agreement contains an increased amount of rent payable by the tenant, the rental payment in the expired or terminated tenancy agreement shall continue for the duration of the Ministerial Order. Any increased amount of rent will come into effect when the Ministerial Order lapses. All other terms in the new tenancy agreement shall remain in full force and effect No new rental rate increases or pre-existing rental rate increases scheduled to take effect are allowed until the Ministerial Order lapses, at the earliest of the following, unless it is continued under the Health Emergency: August 14, 2020; 60 days after the termination of the public health emergency by the Lieutenant Governor, if it is terminated before June 15, 2020; When the Ministerial Order issued by the Minister is terminated because the Minister is satisfied that this Order is no longer in the Public Interest; When this Order is terminated by the Lieutenant Governor in Council.

Information on this topic is also distributed with the Notice of Hearing.... The RTDRS is also starting to schedule in more of the damages-type applications, as the schedule will allow. Wait times for the possession application hearings is down to under 3 weeks, presently.
