My Fellow Leaders, For 10 years we’ve been fighting to update the Real Estate Business Brokers Act, 2002 (REBBA). We have fought for higher standards, better education and modern business tools like personal real estate corporations. ... That hard work, dedication and commitment has paid off. Earlier today, the Ontario Legislature called Bill 145, the Trust in Real Estate Services Act, 2019 (TRESA) for a final vote. Despite the sometimes partisan environment at Queen’s Park, I am thrilled to inform you that TRESA passed unanimously with the support of all parties in the Legislature. WE DID IT! The passage of TRESA is the result of an incredible amount of hard work by staff and volunteers. Since 2009, our Members have had more than 750 meetings with MPPs, sent over 50,000 emails on REBBA and backed four different private members’ bills on Tax Fairness for REALTORS. In 2017, we struck the REBBA Review Taskforce and led the largest direct-to-Member consultation in our Association’s history on a modern REBBA. Our consultation gathered 4,000 bits of Member feedback, reviewing over 50 policy proposals, generating 4 white papers and two final submissions. TRESA is a historic win for Ontario REALTORS. It adopts over twenty OREA recommendations including: Adopting specialty certifications; Stopping a ban on multiple representation; Strengthening the real estate discipline system; Blocking a mandatory auction offer system; and, Permitting personal real estate corporations (PRECs). The Minister has also committed to changing regulations under REBBA to allow Members to use REALTORS or real estate agent in their advertising. But let’s be clear. TRESA passed the final vote in the Legislature, but it’s not law yet. The Act still needs final proclamation and most sections require supporting regulations. Most importantly, the section in TRESA on PRECs requires enabling regulations that will require some consultation to draft. But rest assured your OREA team is on it. Like we did with TRESA, we will push the government to move PRECs forward at the earliest opportunity. So, stay tuned for more announcements and soak it in everyone.
