A Landlord is permitted to take pictures of the inside of the rental unit. Its often believed that a landlord taking pictures of the unit is breaching the privacy of the tenant. The case of Nickoladze v Bloor Street Investments/Advent Property Management, 2015 ONSC 3893 (CanLII) confirms the circumstances in which a Landlord may take pictures of the interior of the tenant’s rental unit. the fact that photographs were taken does not, by itself, constitute an infringement of the tenant’s privacy rights. It would only constitute an infringement if it was done for an improper purpose. Tenants who fail to pay their rent on time face a greatly increased risk of having their tenancy terminated. A tenancy may be terminated if a tenant persistently fails to pay their rent on time. Persistently late is five times in 12 months. In practice the board will give a persistently late paying tenant an opportunity to correct their behaviour at a LTB hearing. But once a board member has put a persistently late tenant on notice that a further late payment will result in termination, an additional late payment will usually result in termination of the tenancy.
