Why you should take a breathalyzer test no matter what: The penalties for refusing to provide a breathe test are the same as those for driving while impaired and with over the legal limit. The consequences include a criminal record, one year driving prohibition, and a $1000-$5000 fine for a first offence, and a mandatory minimum jail sentence for a second offence. You may feel that because you may not have had anything to drink the police officer does not have the right to ...demand that you provide a breath test. Regalrdless of the reasons the consequences of not providing a breathe test are too high, and therefore you should ALWAYS do the test when a police officer makes a demand. 10 Things To Remember If You Get Stopped by the police: Getting pulled over by the police is a frightening experience. Here are some tips to remember to make the experience less stressful while protecting your rights at the same time. 1. Make sure your vehicle registration and insurance slip are in an easily accessible place in your vehicle. You should be able to produce it within a few seconds of the police officer requesting it. 2. Once you see the flashing lights behind ...you, turn on your hazard lights, slow down your speed and safely pull over to the right hand side of the road. Turning on your hazard lights will notify the police officer that you have acknowledged you are being pulled over and that your are trying to stop. 3. Remain calm 4. Be Polite 5. You DO NOT NEED to answer any of these questions: How fast were you going? Have you had anything to drink? Where are you coming from? Where are you going? When was your last drink? The ONLY THING you MUST do when a police officer stops you is IDENTIFY yourself. 6. DON'T LIE about anything especially your name. This will make the situation worse and could result in a criminal charge of Obstruction of Police Officer. 7. If the police insist that you answer any questions don't answer, ask to speak with your lawyer Nicholas Charitsis immediately. 8. If you're asked to provide a roadside breath test YOU MUST comply, even if you know you didn't have any alcohol to drink. So you need to attend court and Don't Have a Lawyer? The Ontario Court of Justice is set up to be (somewhat) user friendly, and for minor court appearances you don't actually need a lawyer with you. If you decide to attend court on your own please make sure to address the Justice correctly. You can differentiate between a Judge and a Justice of the Peace by the colour of the sash worn over the court robes. RED sash is for Judges, GREEN sash is for Justice's of the peace (J.P).... If you are addressing a JP the correct thing to say is "Your Worship". If you are addressing a judge you should say "Your Honour". Do not address a Judge as "Your Worship" - although they may not vocalize it, my experience is that they don't like it! Many people wrongly address a JP (GREEN sash - in traffic court) as "Your Honour". Observe the colour of the sash and you will say the right thing. PLEASE DON'T use the greeting "My Lord", "Your Excellence", "Master", "My Eminence" or anything else. I've been charged with domestic assault - what can I do??? Being charged with domestic assault is really easy these days. The police have a mandate to arrest someone in any domestic related call. This will almost certainly result in bail conditions restricting the person charged from having contact with their domestic partner and from going back to their home. There may even be restrictions from contacting your children. One thing you can do right away in these circumstances ...is to start with a counseling program immediately. This will show good faith on your end and might help us persuade the crown attorney to change your bail conditions. I would be happy to recommend a program to you and assist with the bail variation.
