Many people believe that a common-law unionwhether same-sex or heterois equal to a legally married union in the eyes of the law after a certain number of years. Unfortunately, this is not always so. And the worst time to discover this is when ones partner dies intestate (without a will). If you are married and your partner dies without a will, you are still automatically entitled to at least the preferential share of their estateor all of it, if there are no children.... But in Ontario, if you are not legally married, neither you nor your partner have an automatic right to inherit anything from each other. Without a will, a deceased persons estate would be distributed in this order: children parents siblings nieces and nephews other blood relatives, based on the degree of blood relationship, and finally, to the Crown. As you see, common-law partners are not on this list at all. (Other provinces have different laws: in Saskatchewan, common-law partners automatically become legal spouses for inheritance purposes after two years together.) A common-law spouse who was financially dependent on the deceased can make a claim for financial support, but this means they would have to bring a legal action against their late partners estate. This can be a long and costly process, especially at a time when the person is already distressed. So if you are in a common-law relationship, how can you and your partner protect each other? The best way is to draw up a will, naming your partner in that will. Also ensure that you and your partner are named as beneficiaries in each others life insurance policies, RRSPs, and so on. Do you own a house? Make sure its in both your names, with right of survivorship. And review any joint bank accounts to make sure they too have right of survivorship and will automatically go to your partner. Dont leave it to Fate to make a bad time even worse. If you are an estate trustee, you now have an added responsibility, courtesy of Ontarios Ministry of Finance. Anyone who applied for a Certificate of Appointment of Estate Trustee on or after January 1, 2015, will now have to file an Estate Information Return. Among other things, the EIR confirms the amount of estate administration tax that was paid when applying for the Certificate, and also gives a very detailed disclosure of assets and their values. The EIR must be filed ...within 90 calendar days after a Certificate of Appointment of Estate Trustee is issued. You do not need to include any supporting documents with it, but you should retain those documents in case your EIR is audited. The information you will need to give in the EIR includes: o The deceaseds name, address at time of death, dates of birth and death, and marital status at time of death. o Date of the will, if there is one. o A list of assets, including a description and the value of each. o The amount of the Estate Administration Tax (or deposit) that was paid when filing the Application for Certificate of Appointment of Estate Trustee. The completed return must be delivered to the Ministry of Finance in person, or by mail, courier, or fax. There is at present no email version. However, if the date for giving an EIR to the Ministry falls on a Friday or holiday, the due date will be extended to the next business day. There are conditions under which you do not need to file this form. You can find full details at the governments guide to completing the EIR. An estate trustee who does not file an EIR, or who gives false or misleading statements on one, may be fined at least $1,000 and up to twice the tax payable by the estate, or a prison sentence of up to two years, or both. And if you are feeling somewhat jaded over this additional paperwork, there is a bright side: the governments draft regulation would have given you only 30 days to file the EIR. I read in the newspaper yesterday that only roughly half of adult Canadians have made their wishes known for end of life decisions. Sometimes people will have made a Last Will but did not bother to make a Power of Attorney for Personal Care and a Continuing Power of Attorney for Property. Most people do not just die but may have times in their lives when they are incapable of making health care decisions or in spanked of managing their financial affairs. Dont leave it to chance! Get your affairs in order. Remember: your preparation now will make it easier for your loved ones to follow your wishes in the future.

HST is coming into effect on July 1st. Unfortunately this means that rather than charging 5% for GST, I will be required to charge 13% Harmonized Sales Tax (HST). Other professionals such as accountants and real estate agents will also be required to charge HST.
