United States Patent and Trademark Office (USPTO) systems have been offline since Wednesday, August 15. Kevin Holbeche, owner of Canadian firm Holbeche Law / IP, explained: "Tons of people firms and companies, included use the USPTO's Private PAIR and #EFSweb systems on a daily basis. So, service outages can affect a lot of us." Kevin first realised something was wrong on Wednesday, when he tried to access #PrivatePAIR to download an official filing receipt. He explained ...that the USPTO's site said its systems had been offline since 12:01am for emergency maintenance. USPTO Director Andrei Iancu said the issue stemmed from an internal systems failure, rather than any external causes. The #USPTO reportedly said that the systems would be back up by 5:30am on Thursday. The time was later updated to 10:30am, and then any estimation was removed. Kevin explained that, "In other instances of widespread service interruptions, the agency opted to extend time periods for reply, or provided other relief for those affected." Director Iancu has said that, given the availability of alternative filing and payment methods, they do not plan to extend deadlines. But, they continue to examine options to address concerns over higher paper filing fees. "Lawyers may have to pay higher fees to meet deadlines in the meantime," Kevin added.

Character, Pepe the Frog & Copyright At some point, cartoonist Matt Furie’s Pepe the Frog character went from peaceful frog-dude to recurring character in white supremacist memes. Furie responded by partnering with the ADL - Anti-Defamation League in a #SavePepe campaign (https://is.gd/JTmQy3). He also made a YouTube video (https://is.gd/rQTkzD) about some of his experiences in this respect. > Copyright Dispute Resolved... On another front, Matt Furie and his pro bono lawyers were recently successful in settling a copyright dispute without resorting to litigation. (You can read the American Bar Association’s report here: https://is.gd/Yy6vIw.) It seems, the dispute was over a children’s book which likewise featured a frog named Pepe but promoted conservative views. In the book, Pepe took on a bearded alligator named Alkah and tried to bring law and order to a Wishington farm. Under the settlement, the author of the unauthorized book has admitted to the copyright infringement and agreed to: Cease any further use of the copyrighted character, image, or name of Pepe the Frog. And, Pay all past profits earned from his book to the Council on American-Islamic Relations (www.cair.com). > Crowdfunding Success for Character Meanwhile, Pepe’s creator has now closed a successful Kickstarter crowdfunding campaign (https://is.gd/7G1Db3). So, the frog character might next appear in a new comic book more consistent with its roots. Funders should expect delivery of the comic by this December.
