DESPICABLE AS EVER! BC SPCA TURNED THE EXCELSIOR HOG FARM CRUELTY WHISTLEBLOWER OVER TO POLICE! THE BC SPCA's LEGAL AND MORAL MANDATE is to help suffering animals. But for all the 30 years I have closely watched the BC SPCA, it has actually caused animals to suffer by leaving suffering animals to go on suffering, even though the BC Prevention of Cruelty to Animals Act gives the SPCA more than enough legal ability to seize suffering animals and lay charges against the abusers.... The petitioner made an error when saying: We understand that most of the horrific animal cruelty on Canadian farms is entirely legal, standard practice. The horrific cruelty documented at the Excelsior Hog Farm is not legal standard farm practices. Nor is the degree of cruelty observed at Excelsior Hog Farm legal under the definitions of distress and critical distress in the BC Prevention of Cruelty to Animals Act (PCA Act). The distress documented in April 2019 at Excelsior Hog Farm is more than adequately covered by the PCA Act, which, to my own knowledge, has been used many times by the BC SPCA to seize farm animals, and to have the owners prosecuted. The BC SPCA has shown video and/or a witness’s statement to a Justice of the Peace, or to a judge, to obtain a search warrant (in which the witness is not named), to get its own proof and documentation to seize and charge with. The ITO (Information To Obtain a Warrant), does not need to meet the standard of proof that charges require. My personal knowledge is that the BCSPCA habitually used the signed words of a witness to obtain warrants. (To get a warrant, police must present a judge with an ITO (information to obtain) form that contains reasonable and probable grounds to believe an offence has been or is being committed and that the authorization sought will afford evidence of that offence.
