CUPE 1974 23.11.2020

For any member who has been sent home without pay or has had to take vacation because their scheduled has been cancelled because of reduction of elective surgeries, clinics, please send an email to vicepresident1@cupe1974. Provide details of the circumstances, provide cancelled shifts, dates and times please. We are investigating and seeking payment for members. Update First I would like to thank all of you for your hardwork and dedication. I know this is a trying and frustrating time for all of us and I want you to know that we are working very hard to work through all your concerns. We have received many questions over the last week, days regarding PPE and the change of best practices. We have been working closely with the other President's within KHSC to address concerns to ensure the safety of our members. We have called the Min...istry of Labour in on a number of occasions and they are upholding the hospital guidelines for droplet precautions. All Unions are in agreement that protection needed should follow airborne and droplet precautions. The Employer will not be moved to change their practices, no matter how hard we continue to push. The Employer rational is we need to preserve supplies because of shortages nation wide, to ensure we have what we need in the event things progress. We are grieving this but in the interim are ability to change this is limited. We will be working with our Health & Safety team to provide further updates. In an emergency meeting this morning , Union President's and upper management met to addressed these issues. We will see some changes in screening at entrances and a commitment to have bi-weekly meetings to address concerns. Also, we all woke up this morning to social media and "FORD's" announcement giving Employer's ability to Temporarily suspended collective agreement language and provide them the ability to change work assignments, hours of work, shift schedules. Defer or cancel vacation, leave of absence even if they have been approved. These changes also allow redeployment to alternate work sites, volunteers doing bargaining unit work. Regardless of lay-off, bumping, seniority or service language. Also the suspension of the grievance process. This is only some of what is allowable. The Executive will be on a conference call this evening with OHCU and meeting tomorrow to discuss next steps. We are also aware of cancellation or reduction of elective surgeries and clinics. We have another meeting scheduled for Tuesday to meet with HR to discuss what and who will be effected and plans ahead. We are trying to keep you updated as much as possible and as quickly as possible, however things are changing by the hour and what we may have communicated at one time might have changed in the next minute. So when we have a clear understanding of what is happening we will post it. Our communication officer and Health and safety Chair continue to post as needed. Please know your Executive is available, we are addressing issues. Grievances are being filed, if you have specific questions please reach out to your stewards to assist you. Reposted as Requested Update on Vacation Payout March 6, 2020 Under Article M-2 of CUPE 1974 Local Provisions ... Any vacation in excess of carry over amount as of March 31st shall either be paid out or scheduled by mutual agreement with in 3months. As previously posted the employer will be paying out 50% of any excess vacation over the 1 1/2 times vacation entitlement as of March 31st. Members need to be aware of their vacation entitlement. Any member wishing to minimize the paid out amount of their excess vacation must send notice to their manager and request through KRONOS if this applies to schedule a portion or all excess vacation BY MARCH 31st . Requests for excess vacation must be taken within 3 months ( April 1-June 30th/2020). The time must be mutually agreed with your manager. Any requests after March 31st to use excess vacation will not apply to this provision. Manager's must notify payroll/people services that excess vacation had been scheduled so paid out can be adjusted if it applies. 50% of any excess vacation not used will still be paid out.

Reposting as requested We have had many questions regarding vacation and lieu bank pay outs. We have provided the following explanation which will help clarify. There are 3 different "LIEU" Banks - Stat Lieu - This will not be paid out this year... Overtime Lieu banks -This will not be paid out this year Straight Time Lieu Bank which is only used for departmental/hospital shutdowns. This bank in particular can only be added to when there is a proposed shutdown and will be paid out during the shutdown period to the employee. Any monies left in that bank at the completion of the shutdown will be paid out on the next pay period. Only vacation that is in excess of the 1 1/2 times the entitlement as of March 31st, 50% for this year only will be paid out. Because we have a pay period ending on March 29th and March 30th & March 31st fall in another pay period, excess vacation will be paid out on the April 15th pay period. Beginning in March 2021 all excess vacation as of March 31st will be paid out. We have not got confirmation whether the excess vacation will be paid out on a separate line but regardless all applicable deductions will be taken from the excess vacation paid out. We suggest that everyone check their vacation bank and be aware of what 1 1/2 times your entitlement is. Anything above ,50% will be paid out. The local executive continue to work with the employer to address vacation denial. We will update you when we have further information.
