I am told unofficially via the media that the Minister of Health has announced that Canada will not be appealing the recent decision of Phelan J. in the Federal... Court of Canada declaring that Canada violated the s. 7 Charter constitutional rights of patients by taking away their right to produce their medicine for themselves or have a care giver do so for them and the Government will come up with new regulations in a few months.The Court Order gives them 6 months from feb. 24th,2016.This is very good news and signals the new governments positive approach. We will be going back to Court April 22 to seek a reconsideration of the final order to ensure all MMAR medically approved patients in 2013 on are covered not just those falling within the injunction dates, and enabling change in sites a a few other clarifications.
