Our annual desk decorating competition showcased some amazing creativity, but we could only have one "Best in Show" - Congrats to Crystal! Our Vancouver office "Best Desk" was awarded to Arri, while the by floor winners were Rianne, Trista/Jessica, and Janet, and Robin took home the best "Remote Desk". Best sweater went to Kim and best mask went to Linda. Thanks to everyone for participating and getting us all in a festive spirit!

Today, we celebrate Trista Foreman, Commercial Finance Paralegal, and congratulate her on 10 years with our firm! A decade brings a significant amount of change to anything and Trista’s relationship with our firm was not immune to change. The Trista we now know first started as a young idealist clerk in litigation, before her journey took her through many other positions and departments. Trista spent time in our Indian Residential School claims department, as a solicitor floa...ter, and as a dedicated solicitor assistant. Through it all, Trista has shown loyalty, determination, resilience and commitment. She has given up her time to assist with volunteer campaigns, stepped up to new positions when needed, and helped in areas outside her role, all while balancing her paralegal courses. This past year she graduated from the Paralegal program - much hard work and sacrifice realized! We value her energy, team focused approach and her positive attitude. Today, we celebrate Geri Rines, paralegal, on her 25th Anniversary with our firm! Originally hailing from Princeton, then Calgary, Geri joined our firm in 1995 and has since been a valuable member of our Personal Injury practice. Previously, she had a varied and interesting work history that included being a Columbia/Tri-Star Films distribution booker, dealing with approximately 110 theatres throughout Western Canada. Anyone who knows Geri knows how hardworking, reliable, an...d loyal she is. She has always truly cared for clients, taking a personal interest in all of her files, which is reflected in terms of the relationships she develops with both the lawyer responsible for the file and the clients. Determined and courageous, Geri has maintained her positive outlook, her professionalism and her dedication to her work, even in the most difficult of times. Our Personal Injury Team is thrilled to announce that Tristenne Seddon (Kamloops School of the Arts) has been named as our 2020 Athlete of Influence and recipient of the $1000 scholarship. Tristenne has demonstrated every element that this scholarship represents, being: a commitment to healthy living, resilience in the face of adversity, and a dedication to giving back to her community. Tristenne has had a very successful career as a young athlete, playing hockey and soccer, ...and competing in track and field events (shot put, long jump, high jump, 100m and 4x100m relay). She has captained both her hockey and soccer teams, demonstrating strong leadership qualities. Tristenne has consistently been on the Effort and Honour Roles and, has received numerous accolades for athletics and academics. She has also pushed herself beyond her comfort zone, taking drama and acting courses to improve both her public speaking and confidence. Tristenne is resilient. For her, being active is therapeutic. Tristenne has wisely chosen to use sports as part of her depression and anxiety management strategy, saying that the more time she spends expending energy through sports, the better she feels. After graduation, Tristenne will attend TRU to pursue a degree in Psychology, with plans to eventually become a RCMP profiling officer or a prosecuting lawyer. She hopes to one day play for the Canadian National Womens Hockey Team, leading to an opportunity to coach and mentor other players, especially those who are struggling with mental health issues. We have no doubt she has a very bright future ahead of her and will be an asset to those around her wherever she goes! The other Top 10 Finalists were: Katerina Loschiavo, Halle Smith, Akela Pryce, Matthew Ciardullo, Tyler Fernie, Carsen Moffett, Leah Demsey, Jeremy Helly, and Cori Oyer. International Womens Day on Sunday got us thinking about how much things have changed in our law firm over the years. We found these photos deep in our archives, and we asked a few people who were around then what has changed. Heres a few (that we were amazed by!): Smoking at your desk was permitted. Lawyers went to court with actual BOOKS of case law, because we didnt have photocopiers. If you made a mistake on a letter you often had to re-type the whole page. ... Someone stood at a shredding machine and fed the papers into it one at a time OR confidential papers were burnt at a beehive at a sawmill instead. All messages were written down and handed to the lawyers, as there was no voicemail. No fax machine but we did have a telex machine. We would type on a strip with holes and then feed the tape into the machine, which sent the characters to the recipient machine over telephone lines. We had memory typewriters, but they didnt hold very much memory. #FultonFriday #Flashback

Here is a common (although incorrect) statement: I dont need a Power of Attorney! After all, my spouse already has access to everything because all our bank accounts are held jointly and we co-own our house. Unbeknownst to many, without a legal Power of Attorney (aka POA) your spouse has no automatic authority to deal with your assets. And, if you become incapable because of illness, disease, or accident, your spouse could not sign on your behalf to sell your interest in t...he house, manage your investments, deal with your car insurance, etc. This is where your POA comes in. The key is to make a POA before your capacity fails to the point where you are legally incapable of signing this document. Anyone who has assets of any kind should make a POA. Questions? Doesnt my spouse just get everything anyway (since we co-own everything together)? That might work, as long as you die first. In that case your spouse would keep all your jointly owned assets. (More info at fultonco.com/practice/wills-estates) But once theres only one spouse alive, that spouse needs a Will to pass on their assets. Since we never know whos going to die first, that means both spouses need their own Wills. There are other reasons you need a Will. Even if you... die without a penny to your name, you need an Executor to make funeral arrangements and to look after the winding up your affairs after you die, like filing your last tax return - Canada Revenue Agency needs to see a Will, to confirm there is an appointed Executor to process the tax return. We were thrilled to attend the unveiling of the official Fulton Law Student Lounge at Thompson Rivers University (TRU) last week. The TRU Law School officially opened in 2014, as the first new law school in Canada in 30 years. That year and in honour of our firms 125th Anniversary, our firm gifted $125,000 to future student awards. The Fulton Law Student Lounge was named in recognition of this contribution. How do you Value a Business for Support Payments? If you are going through a separation, and your partner owns a business, then it is important to get legal advice to ensure that you are receiving proper child or spousal support. Child or spousal support payments are primarily determined by the payors income. For employees, calculating income is usually as straight forward as looking at their tax return. However, if the individual owns a business, their tax return may not a...ccurately reflect how much money they have actually earned. This is because our tax laws allow business owners to deduct money used for personal benefit from their income. However, from a family law perspective, a portion of these expenses may be included in the individuals income when calculating child or spousal support payments. If the business owners reported income does not accurately reflect how much money they actually have, then the court may impute or add back the improperly deducted money to their income, resulting in larger support payments.
